Selling An East Side One…

While the City of Warren grapples with a downtown parking proposal, some public parking on the east side has been put up for sale.

In a series of motions, Warren City Council approved putting the Elm St. parking lot up for sale during the June meeting held on Monday.

City Solicitor Andrea Stapleford acknowledged that the sale of the lot has “been a matter of discussion for some time. The survey and legal research has been completed.”

Costs incurred in preparing the lots for service came in at $9,000, according to Stapleford.

Council then took a series of actions that were required to put the lot, which is actually three distinct parcels, up for sale.

Councilman Gregory Fraser made each of the following motions, which were all approved unanimously:

A quitclaim deed for a 30-foot by 14-foot portion of the lot.

That the city “enter into a boundary line agreement that would define the northerly part of the property and that that northerly property line agreement be entered into with the property owners adjoining to the north.”

To place one of the parcels for sale by sealed bid to the highest bidder plus costs of $3,500 with the condition that the “lot would be subject to easements for ingress and egress for all property owners on the north side of the lot.”

To place another parcel for sale in the same manner, also with the $3,500 in costs “subject to a condition that the lot be used for parking.”

To place a third parcel for sale in the same manner, with costs at $2,000 “and subject to (an) easement as presently exists as a license agreement… servicing a drive-through operation… with said easement to exist as long as the drive through business exists.”

Council tasked administration in January with negotiating the boundary line agreement.

At the time, City Manager Nancy Freenock said surveys had been completed on the lot that do not mirror the parcel descriptions on file at the Warren County Courthouse.

She said city administration is, “asking council to accept property line agreements with some surrounding owners to adjust (the) legal description to reflect the situation on the ground.”

In January, council also authorized negotiation of easements for the parcels which house businesses that front on Pennsylvania Avenue.
