Judge hands down 13 defendants’ sentences

Judge Maureen Skerda sentenced 13 defendants during sentence court on Friday.

Receiving sentences were:

Jessica M. Albares, 407 Market St., to 27 to 54 months in a state correctional institution, $2,125 in fines and fees, to undergo a drug and alcohol evaluation for a charge of contraband and possession of a controlled substance. Two charges of contraband and possession of a controlled substance were not prosecuted.

Nicholas Keith Bennett, 1484 Oil Creek Rd., Spring Creek, to 48 days to two years, less one day in the Warren County Jail, $1,550.16 in restitution, $1,800 in fines and fees, to undergo a drug and alcohol evaluation for a charge of receiving stolen property, bad checks, and theft by deception. Bennett was ordered to have no contact with the victim and is eligible for parole pending approval of a plan from the probation department. Charges of driver required to be licensed, careless driving, theft by deception, and three charges of bad checks were not prosecuted.

James Dale Blankenship, 207 Madison Ave., to 60 to 120 months in a state correctional institution with credit for time served, $1,625 in fines and fees for a charge of failure to comply with registration of sexual offenders. Blankenship is not RRRI eligible.

Luke Aaron Conklin, 533 Crescent Park, to one year probation, $750 in fines and fees, 30 hours of community service for a charge of possession of drug paraphernalia. A charge of possession of controlled substance was not prosecuted.

Courtney Marie Edwards, 227 Stowe St., Apt. 1, Jamestown, N.Y., to five days to two years, less one day in the county jail with credit for time served, $1,000 in restitution, $1,375 in fines and fees, to undergo mental health evaluation and follow recommendations for a charges of theft by unlawful taking. Charges of burglary, criminal trespass and criminal mischief were not prosecuted. Edwards was ordered to submit a letter of apology to the victim through the court.

Jason Lawrence Harkins, 355 Main St., Pittsfield, to 30 days to six months in the county jail, $1,765 in fines and fees, 15 hours of community service, complete family treatment court for a charge of DUI: highest rate alcohol, careless driving, and immediate notice of accident to police department. Charges of DUI: general impairment incapable of safe driving, driving on roadways laned for traffic, driving vehicle at safe speed, reckless driving, accidents involving death or personal injury, operation on streets and highways and operation in safe manner were not prosecuted. Harkins is early re-entry and work release eligible.

Ashley Marie Johnson, 1027 Matthews Run Rd., Youngsville, to 144 hours to 12 months in the county jail, $3,515 in fines and fees, complete family treatment court, 30 hours of community service for charges of DUI: highest rate of alcohol, careless driving, DUI: combines alcohol and drug or combination of drugs and driver required to be licensed. Charges of DUI: general impairment incapable of safe driving, maximum speed limits, DUI: controlled substance impaired ability were not prosecuted. Johnson is early re-entry and work release eligible.

Ashley Renee Mighells, 901 Lincoln Ave., to $675 in fines and fees for a charge of retail theft. A charge of theft by unlawful taking was not prosecuted.

William J. Moore, 20 Tollgate Rd., Sheffield, to 30 days to six months in the county jail, $995 in fines and fees, 15 hours of community service, a 12-month license suspension, attend the alcohol highway safety school and victim impact panel programs for charges of DUI: minors and careless driving. Charges of DUI: general impairment incapable of safe driving, purchase, consumption, etc. of liquor and stop signs and yield signs were not prosecuted. Moore is early re-entry and work release eligible.

Richard Robert Reilly, 504 Mead Ave., Corry, to 18 to 60 months in a state correctional institution with credit for time served, $1,625 in fines and fees for a charge of failure to comply with registration of sexual offenders.

Bryan Michael Smith, 2618 Cable Hollow Rd., Russell, to two years probation, $750 in fines and fees, 50 hours of community service for a charge of simple assault. A charge of simple assault, two charges of terroristic threats, and two charges of harassment were not prosecuted.

Robin Leann Smith, 44 Sampson St., Jamestown, N.Y., to five years intermediate punishment with 90 days in the county jail, 90 days in patient treatment, 12 months in a halfway house and the balance of the five years under the general supervision of the probation department, $2,640 in fines and fees, attend the alcohol highway safety school and victim impact panel programs, a 18-month license suspension, and 30 hours of community service for DUI: highest rate of alcohol, required position and method of turning and careless driving. Charges of DUI: general impairment incapable of safe driving, driving on roadways laned for traffic and restriction on alcoholic beverages were not prosecuted.

Wayne Martin Spicer, 163 Saybrook Rd., Sheffield, to two years probation, $2,000 in restitution, $750 in fines and fees and 50 hours of community service for a charge of simple assault. Charges of simple assault and harassment were not prosecuted.

Lesley Michelle Terry, 800 1/2 W. Fifth Ave., to four years probation, $6,249.28 in restitution, $1,250 in fines and fees for a charge of theft by unlawful taking. A charge of receiving stolen property was not prosecuted.

Tyler Dwayne Wilson, 2545 Liberty St. Ext., to two years probation, $180 in restitution, $750 in fines and fees, to undergo a drug and alcohol evaluation, to undergo anger management evaluation and follow all recommendations, and 30 hours community service for a charge of simple assault.
