Warren woman found guilty, not guilty during jury trial
A Warren woman was found guilty of misdemeanor simple assault but found not guilty of felony aggravated assault during a jury trial on Dec. 10.
According to a release from the Warren County District Attorney’s office, Heather Nichole Smith, 413 Fourth Ave., was found guilty striking a victim “with closed fists multiple times in the area of the face and head.” The simple assault conviction comes with a maximum penalty of two years in jail and up to a $5,000 fine.
Smith was found not guilty of felony aggravated assault (extreme indifference).
The incident occurred on May 25.
President Judge Maureen Skerda presided over the trial. Assistant Public Defender Alan Conn represented Smith while Assistant District Attorney Caleb Gnage prosecuted the case for the Commonwealth.
