15 sentenced in Warren County court

A Warren woman involved an incident in which she doused a house with gasoline in June was sentenced before Judge Maureen Skerda Friday morning along with fourteen other individuals during Warren County sentence court proceedings.

On June 20, police responded to a report that Deborah Ann Miles was inside David Brewer’s residence at 102 Hammond St. armed with kitchen knives and attempting to set the premises on fire.

According to the criminal complaint filed against Miles, she was smoking bath salts with Brewer when they got into a verbal altercation in which she threatened to kill Brewer and burn down the residence. The altercation became physical and Brewer threw Miles out of the house. Miles then kicked in the back door and Brewer fled the residence. When police searched the home, Miles had left, but they found a five-gallon gas can and some of the rooms doused with gasoline.

Police charged Miles with arson and related offenses (endangering another person), recklessly endangering another person, terroristic threats and criminal mischief in the incident.

As a result of an agreement with the district attorney’s office, Miles eventually entered a plea of guilty to the charge of terroristic threats and the remaining charges were dropped.

Skerda sentenced Miles to serve between eight and 24 months less one day incarcerated in the Warren County Jail with credit for 81 days time served, one year of probation, 200 hours of community service, undergo a drug and alcohol evaluation and comply with treatment recommendations and pay $1,225 in fines and costs.

Skerda noted Miles extensive drug-related criminal record and said she would consider early release to an in-patient treatment facility for Miles.

Other sentences handed down included:

Robert F. Carnegie, 64 Keystone Ave., Sheffield, to one year of probation, a six month suspension of driving privileges, 40 hours of community service, pay $735 in fines, costs and restitution and to have no contact with his victim for a charge of accident with damage to attended vehicle or property.

Timothy Kyle Cruickshank, 209 Market St., Apt. 402, to six months probation and pay $695 in fines, costs and restitution for a count of theft of property.

William R. Finch, 18 Phillips St., Jamestown, NY, to between 90 days and two years less one day incarceration in the Warren County Jail, one year of probation, 150 hours of community service, not to trespass on the premises of Walmart and pay $1,550 in fines and costs for one count each of retail theft and drivers required to be licensed.

Jessie Joe Greenhalgh, 1301 Pennsylvania Ave. East, to between six months and one year incarceration in the Warren County Jail with credit for 43 days time served, a six month suspension of driving privileges, to undergo a drug and alcohol evaluation and comply with treatment recommendations and pay $1,025 in fines and costs for one count each of possession of a controlled substance and public drunkenness.

Kenneth Albert Hadden, 1110 Madison Ave., to between 28 days and two years less one day incarceration in the Warren County Jail with credit for 28 days time served, 50 hours of community service, attend and complete high school, have no contact with his victim and pay $600 in fines and costs for a count of obstructing administration of law or other governmental function.

In a separate incident, to between 93 days and one year incarceration in the Warren County Jail with credit for 93 days time served, 30 hours of community service and pay $425 in fines and costs for a count of receiving stolen property.

Christopher William Hoffman, 109 W Fifth Ave., to between four months and two years less one day incarceration in the Warren County Jail with credit for 20 days time served, four years probation, 225 hours of community service and pay $7,881.99 in fines, costs and restitution for a felony count of criminal mischief.

In a separate incident, to one year probation, 30 hours of community service and pay $889.85 in fines, costs and restitution for a misdemeanor count of criminal mischief.

Clarence Laverne Kelwaski, 14 Sciota St., Jamestown, NY, to pay a $100 fine for a count of defiant trespass.

Jessica Lamper, 120 Newland Ave., Jamestown, NY, to two years of probation, thirty hours of community service, maintain employment unless deemed medically unable to work and pay $625 in fines and costs for a count of retail theft.

Joseph Paul Pratt, to one year of probation, 30 hours of community service, undergo a drug and alcohol evaluation and comply with treatment recommendations and pay $575 in fines and costs for a count of retail theft.

Scott Michael Simmons, 213 Vine St., to between 30 days and six months incarceration in the Warren County Jail, 12 months suspension of driving privileges, attend the alcohol highway safety school and victim impact panel, continue outpatient drug and alcohol treatment and comply with all treatment recommendations from Family Services of Warren County, 30 hours of community service and pay $905 in fines and costs for one count each of DUI: General impairment – incapable of safe driving and careless driving.

John Edwin Snyder, to between eight and 18 months incarceration in the Warren County Jail with credit for 87 days time served, three years probation, 200 hours of community service, six months suspension of driving privileges, submit a DNA sample to the state police database, undergo a drug and alcohol evaluation and comply with treatment recommendations and pay $3,775 in fines, costs and restitution for a count of possession with intent to deliver.

Robert Craig Thomas, 102 6th Ave., 1st floor, to between 72 hours and six months incarceration in the Warren County Jail with credit for 48 hours time served, 12 months suspension of driving privileges, 15 hours of community service, attend the alcohol highway safety school, victim impact panel and DUI intervention program and pay $1,600 in fines and costs for a count of DUI: Highest rate of alcohol (BAC .16+).

Donald John Wayne, 3103 Farnsworth Rd., Clarendon, to between 48 hours and six months incarceration in the Warren County Jail, 12 months suspension of operating privileges, 15 hours community service, attend the alcohol highway safety school and victim impact panel, undergo a drug and alcohol evaluation and comply with treatment recommendations and pay $1,105 in fines and costs for one count each of DUI: High rate of alcohol (BAC .10 – .16) and careless driving.

Lucas Jacob Baines Wolfgang, 208 Parkview Ave., Jamestown, NY, to between 48 hours and six months incarceration in the Warren County Jail, 12 months suspension of driving privileges, an additional one year suspension of driving privileges, 15 hours community service, attend the alcohol highway safety school and victim impact panel, continue drug and alcohol treatment through Jones Memorial Health and pay $1,130 in fines and costs for one count each of DUI: High rate of alcohol (BAC .10 – .16) and driving while under suspension.

Skerda also issued a bench warrant for Brandon Joseph Fox, 26 1/2 S. South St., rear apt., for failure to appear on a count of sell/furnishing liquor etc. to minors.
